ASSET TRAINING ACADEMY – TERMS & CONDITIONS OF ENROLMENT

1. DEFINITIONS & ACCEPTANCE

By booking a course with Asset Training Academy Pty Ltd (ATA), the Student (and the Employer, where applicable) agrees to be strictly bound by these Terms. These Terms constitute the entire agreement between the parties regarding conduct and liability.

2. FEES & REFUND POLICY

2.1. Acceptance of Policy: By booking a course, the Student acknowledges they have read, understood, and accepted the separate ATA Refund & Cancellation Policy.

2.2. Payment: All fees must be finalized prior to the commencement of training. ATA reserves the right to refuse entry to any student who has not paid in full.

2.3. "No Pass, No Refund" & Re-Assessment Guarantee: Course fees cover the delivery of training and assessment, not the guaranteed issuance of a licence. If a student is deemed "Not Yet Competent" (Fail) on their first formal assessment attempt:

  • For designated courses only: ATA provides one (1) complimentary subsequent re-assessment attempt for that specific course component with zero ($0) re-assessment fees.

  • For all other high-risk courses: Standard re-assessment fees will apply immediately to any subsequent testing attempts.

  • Note: ATA reserves the right to void any complimentary re-assessment guarantee if a student is removed from the yard for misconduct under Section 3.1.

2.4. Non-Refundable Deposits: The Student acknowledges that deposits paid at the time of booking are immediate and non-refundable. These funds are used to secure external enrolment and administrative processing with our RTO partners. Once paid, these funds cannot be recovered or reversed.

2.5. Rescheduling & Course Date Alignment: While deposits are strictly non-refundable, ATA will make reasonable commercial efforts to assist a student facing genuine scheduling conflicts by transferring their booking and deposit to a future session. All rescheduled bookings are strictly subject to seat availability and must align entirely with ATA’s existing, publicly scheduled course calendar. ATA is under no obligation to create custom, private, or unscheduled training dates to accommodate a student’s rescheduling request.

3. STRICT SAFETY & CONDUCT POLICY

3.1. Zero Tolerance: ATA operates a zero-tolerance policy towards unsafe behaviour, aggression, or refusal to follow instructions. The Trainer has the absolute right to terminate a student's training immediately. In such cases, no refund will be issued.

3.2. Drugs & Alcohol: Students must present with a 0.00% Blood Alcohol Concentration and be free from the influence of drugs. ATA reserves the right to request a breathalyzer test. Refusal or failure results in immediate expulsion.

3.3. PPE: Students must arrive wearing compliant Personal Protective Equipment (PPE) as directed (e.g., closed-in shoes, comfortable sun-safe clothes). Failure to wear PPE prevents entry to the yard and will be treated as a "No-Show" under the Refund Policy.

4. LATENESS & ATTENDANCE

4.1. Start Times: Training commences strictly at the scheduled time.

4.2. Safety Induction: Students arriving late who miss the mandatory safety induction will be refused entry to the course. This is non-negotiable due to WHS laws and will be treated as a "No-Show" with full forfeiture of fees.

5. FITNESS TO PARTICIPATE & DISCLOSURE

5.1. Duty to Disclose: The student must disclose any medical condition (e.g., vision, epilepsy, diabetes, back injury) or Language, Literacy, and Numeracy (LLN) difficulty at the time of booking.

5.2. Failure to Disclose: If a student arrives and is unable to complete the course due to an undisclosed condition or inability to read/write English, training will be ceased and no refund offered.

6. DAMAGE TO EQUIPMENT

6.1. Liability: The student (and their employer) accepts liability for any damage caused to ATA machinery, equipment, or property resulting from the student’s negligence, recklessness, or failure to follow trainer instructions.

6.2. Recovery of Costs: ATA reserves the right to recover the full cost of repairs and/or insurance excess from the student/employer in such events.

7. PRIVACY & MEDIA EVIDENCE

7.1. Mandatory Assessment Evidence: The student acknowledges that ATA is required by Workplace Health and Safety Queensland (WHSQ) to capture photographic and video evidence of the student operating machinery for assessment purposes. This is a mandatory condition of licensure.

7.2. Marketing: ATA may capture separate images for marketing purposes. Students may opt-out of marketing images by advising the trainer prior to commencement.

8. STUDENT TRAVEL & PERSONAL VEHICLES

8.1. Private Travel: Travel between the ATA training centre and any off-site practical location (e.g., a third-party worksite or machinery yard) is the sole responsibility of the Student. This travel is deemed "private commuting."

8.2. No Liability: ATA accepts no liability for any accident, injury, loss, or damage to personal vehicles or property that occurs during travel to or from training locations.

8.3. Vehicle Compliance: If a Student chooses to use their own vehicle, they warrant that the vehicle is registered, roadworthy, and comprehensively insured.

8.4. Parking: ATA is not responsible for any parking fines, clamping, or theft of vehicles parked at or near training locations.

9. INDEMNITY & WAIVER

9.1. Acceptance of Risk: The student acknowledges that High-Risk Work training involves inherent physical risks. The student enters the training facility and operates machinery at their own risk.

9.2. Waiver: To the maximum extent permitted by law, the student releases and indemnifies ATA, its staff, and agents from any claim, liability, loss, or injury arising out of the student's participation in the training, except where caused by the direct negligence of ATA.
